Violation by Minors:
It shall be unlawful for any minor under the age of eighteen (18) to remain, linger, stay, congregate, move about, wander, or stroll in any public place or semi-public place in the City of Leesburg, either on foot or in or upon any vehicle, during restricted hours. Restricted hours are defined as the hours between 12:00 midnight and 6:00 A.M. the following day. The Ordinance lists numerous exceptions such as attending school and church sponsored events and returning home from such events using the most direct route, without any detours or stops along the way; and when the minor is accompanied by a parent. It shall be unlawful for any minor under sixteen (16) years of age who has been suspended or expelled from school to be or remain in any public place or semi-public place, or to be within 1000 feet of a school, between 8:00 A.M. and 3:00 P.M. on any school day.
Responsibility of Parents:
It shall be unlawful for a parent, guardian, or other person at least twenty-one (21) years of age having the care and control of a minor to permit or by insufficient control to allow, such minor to remain, linger, stay, congregate, move about, wander or stroll in any public or semi-public place during restricted hours.
Responsibility of Operators:
It shall be unlawful for the operator of any business to knowingly permit a minor to remain, linger, stay, congregate, move about, wander or stroll upon the premises of the business during restricted hours. Operators are encouraged but not required to conspicuously post in or about their business premises a notice of the Ordinance.
Penalties:
- A minor who violates the ordinance is guilty of a "civil infraction" and shall be fined $50.00 for each violation.
- A parent, guardian or other person at least twenty-one (21) years of age, having the care and control of a minor who violates this ordinance is guilty of a "civil infraction" and shall pay a fine of $50.00 for the first violation and a fine not to exceed $500.00 for subsequent violations.
- A business operator who violates the ordinance is guilty of a "civil infraction" and shall pay a fine of $50.00 for the first violation and a fine not to exceed $500.00 for subsequent violations.
