Subject: Resolution authorizing an agreement with Cutrale Citrus Juices USA, Inc. for the City to perform work on natural gas lines within Cutrale’s boundaries

Staff Recommendation:

Staff recommends approval of an agreement with Cutrale Citrus Juices USA, Inc., for the City to perform work on natural gas lines within Cutrale's boundaries

Analysis:

The City provides natural gas service to a processing plant for citrus and other agricultural and food products, operated by Cutrale within the City of Leesburg. Cutrale is renovating a portion of its facility, as a consequence of this, the natural gas lines within and outside the boundaries of Cutrale’s property will require relocation. As the provider of natural gas service, the City will relocate lines outside Cutrale’s property. Cutrale is responsible for relocating the lines within its boundaries; but has not been able to find an outside contractor to assemble and weld together the sections of natural gas line on its property. Cutrale has requested the City to provide that service. The City has agreed to provide the requested service, but only under the terms and conditions of this Agreement.

Options:

1. Approve the Agreement with Cutrale Citrus Juices USA, Inc.; or

2. Such alternative action as the Commission may deem appropriate

Fiscal Impact:

No fiscal impact to the City of Leesburg. All costs will be reimbursed by Cutrale.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH CUTRALE CITRUS JUICES USA, INC., FOR THE CITY TO PERFORM WORK ON NATURAL GAS LINES WITHIN CUTRALE'S BOUNDARIES; AND PROVIDING AN EFFECTIVE DATE

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LEESBURG, FLORIDA:

THAT the Mayor and City Clerk are hereby authorized to execute an agreement with Cutrale Citrus Juices USA Inc., whose address is 11 Cloud street, Leesburg, Florida

34748, for natural gas line assembly on its property.

THAT this resolution shall become effective immediately.

PASSED AND ADOPTED by the City Commission of the City of Leesburg, Florida, at a regular meeting held the _23rd____ day of _April________ 2012.
