The following information is provided as a resource guide for understanding your rights as a victim of a crime and is provided by the State Attorney's Office of the Fifth Judicial Circuit.
As the State Attorney for the Fifth Judicial Circuit, I believe it is essential that victims and witnesses know the rights that are afforded to you by Florida Law. Knowing and exercising your rights strengthens existing laws and leads to the development of new laws which make the criminal justice system more responsive and sensitive to the needs of victims.
I believe victims of crime should be treated with respect and dignity and have the opportunity to participate in the criminal justice process. Your participation provides important information to law enforcement, the State Attorney’s Office and the courts.
This brochure is but one small part of the criminal justice process; informing you of your rights and providing information on local community resources that might be of assistance to you.
I encourage you to read this brochure and discuss any questions or concerns you have with someone in law enforcement or a Victim/Witness Counselor at the State Attorney’s Office.

Victim's Rights and Compensation
You have the right to information concerning the availability to Crimes Compensation and assistance in completing a Crimes Compensation application. (Crimes Compensation is available to eligible applicants who are the victim of violence or to family members for the funeral expense of a loved one.)
You have the right to submit a written and oral Victim Impact Statement to the court. A Victim Impact Statement provides you with the opportunity to document your losses, injuries and express your feelings about the crime.
Incarcerated victims have the right to submit a written Victim Impact Statement.
You have the right to request a timely disposition of your case.
You have the right to information concerning your role as a victim or witness of a crime and the resources that are available in your community to assist you.
You have the right to information on steps that are available to law enforcement and the State Attorney’s Office to protect victims and witnesses of crime from intimidation.
You have the right to have your property returned to you unless there is a compelling law enforcement reason for retaining it.
You have the right to request assistance in explaining to your employer/creditor the necessity of your participation in the criminal justice process and the financial strain you may have incurred because of having been the victim of a crime.
You have the right to consult with the Office of the State Attorney about pre-trial diversion programs or plea negotiations in your case.
You have the right to request the presence of a victim advocate during discovery depositions.
You have the right to request assistance with parking, transportation or other needs that may arise as the result of your participation in the criminal justice process.
You have the right to be present, informed and when relevant, heard at all crucial proceedings.
Victims of sexual battery, aggravated battery, aggravated child abuse, aggravated stalking, harassment, battery or domestic violence have the right to request in writing that identifying information be exempt from public record.
You have the right to seek restitution from the defendant. Please keep track of your losses.
You have the right to be informed if the defendant should be released or escape from a commitment facility. IN MOST CASES, FLORIDA LAW ALLOWS FOR AN ARRESTED PERSON TO BOND OUT OF JAIL PENDING FURTHER JUDICIAL PROCEEDINGS. IF YOU HAVE QUESTIONS CONCERNING THE ARRESTED PERSONS BOND STATUS, PLEASE CONTACT THE INCARCERATING FACILITY (JAIL). THE ARRESTING OFFICER CAN PROVIDE YOU WITH THE NAME AND PHONE NUMBER OF THE JAIL IN WHICH THE ARRESTED PERSON IS BEING HELD.
You have the right to review portions of a pre-sentence investigative report prior to the sentencing hearing. Please contact the State Attorney’s Office handling your case.
Victims of crime and the State Attorney, with the consent of the victim, have standing to assert the rights of a crime victim, which are provided by Florida law and the State Constitution.
You have the right to be notified of all judicial proceedings involved in your case. If you have been scheduled to appear at any judicial proceeding, you have the right to be notified of any changes that would effect your attendance.
